Granum End User License Agreement

Agreement to Terms

This End User License Agreement ("EULA") is a legal agreement between you and Saentisoft ("we", "us", "our") governing your use of the Granum mobile application ("the App"). By downloading, installing, or using the App, you agree to be bound by this EULA. If you do not agree to these terms, do not download or use the App.

Acknowledgement

This EULA is concluded solely between you and Saentisoft, and not with Apple Inc. ("Apple"). Saentisoft, not Apple, is solely responsible for the App and its content. This EULA does not provide for usage rules for the App that conflict with the Apple Media Services Terms and Conditions in effect as of the effective date of this EULA, and you acknowledge that you have had the opportunity to review those terms.

Scope of License

Subject to your compliance with this EULA, Saentisoft grants you a limited, non-exclusive, non-transferable license to use the App on any Apple-branded products that you own or control, and as permitted by the Usage Rules set forth in the Apple Media Services Terms and Conditions, except that the App may also be accessed and used by other accounts associated with you via Family Sharing or volume purchasing. This license does not include the right to sublicense the App to any third party.

Restrictions

You may not, and you may not permit others to:

• Copy, modify, or create derivative works of the App or its content
• Reverse-engineer, disassemble, decompile, or attempt to derive the source code of the App
• Sell, rent, lease, sublicense, or otherwise transfer rights to the App
• Remove or alter any proprietary notices or labels on the App
• Use the App in any way that violates applicable laws or regulations
• Use the App for any commercial purpose without our express written consent

Intellectual Property

The App and all rights, title, and interest in and to the App, including all intellectual property rights, are and remain the exclusive property of Saentisoft. This EULA does not grant you any rights to trademarks, service marks, or logos of Saentisoft. All rights not expressly granted to you in this EULA are reserved by Saentisoft. In the event of any third-party claim that the App or your possession and use of the App infringes that third party's intellectual property rights, Saentisoft, not Apple, is solely responsible for the investigation, defense, settlement, and discharge of any such claim.

Your Content and Data

All shot pattern data, photographs, equipment logs, and session records you create within the App are stored locally on your device. You retain ownership of your content. Saentisoft does not claim any ownership over data you create using the App. You are solely responsible for maintaining backups of your data. Our handling of any limited data we do process is described in the Granum Privacy Policy .

App Store Terms

The App is distributed through Apple App Store and Google Play Store. Your use of the App is also subject to the applicable app store's terms of service. In the event of any conflict between this EULA and the applicable app store's terms, this EULA shall govern to the extent permitted by the app store's terms.

Third-Party Components

The App incorporates third-party open-source components and may connect to third-party services for weather data and crash reporting (Sentry). Third-party open-source components are licensed under their respective licenses. Third-party services are subject to their own terms and privacy policies. Saentisoft is not responsible for the practices of any third-party services.

Updates

Saentisoft may from time to time provide updates, patches, or new versions of the App. Such updates may be required to continue using the App and may modify or remove functionality. This EULA applies to all updates unless a separate license accompanies the update. We reserve the right to modify this EULA at any time by updating the effective date. Continued use of the App after changes constitutes acceptance of the updated EULA.

Maintenance and Support

Saentisoft is solely responsible for providing any maintenance and support services with respect to the App, as described in this EULA or as required under applicable law. Apple has no obligation whatsoever to furnish any maintenance and support services with respect to the App.

Disclaimer of Warranties

The App is provided "as is" and "as available" without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement, to the extent such warranties are not effectively disclaimed under applicable law. Saentisoft does not warrant that the App will be uninterrupted, error-free, or secure. Ballistic calculations, pattern analysis, and weather data are provided for informational purposes only and must not be relied upon as the sole basis for any decision involving firearms or ammunition. In the event of any failure of the App to conform to any applicable warranty, you may notify Apple, and Apple will refund the applicable purchase price for the App to you. To the maximum extent permitted by applicable law, Apple has no other warranty obligation whatsoever with respect to the App, and any other claims, losses, liabilities, damages, costs, or expenses attributable to any failure to conform to any warranty are Saentisoft's sole responsibility.

Limitation of Liability

To the fullest extent permitted by applicable law, Saentisoft shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of data, profits, or goodwill, arising out of or related to your use of or inability to use the App, regardless of the legal theory and whether or not Saentisoft has been advised of the possibility of such damages. Saentisoft's total liability for any claim arising out of this EULA shall not exceed the amount you paid for the App, if any.

Product Claims

Saentisoft, not Apple, is responsible for addressing any claims by you or any third party relating to the App or your possession and/or use of the App, including, but not limited to: (i) product liability claims; (ii) any claim that the App fails to conform to any applicable legal or regulatory requirement; and (iii) claims arising under consumer protection, privacy, or similar legislation. Nothing in this EULA limits Saentisoft's liability to you beyond what is permitted by applicable law.

Legal Compliance

By using the App, you represent and warrant that (i) you are not located in a country that is subject to a U.S. Government embargo, or that has been designated by the U.S. Government as a "terrorist supporting" country; and (ii) you are not listed on any U.S. Government list of prohibited or restricted parties.

Third-Party Terms of Agreement

You must comply with any applicable third-party terms of agreement when using the App. For example, if the App connects to network or data services, your use of the App must not cause you to be in violation of your wireless data service agreement or any other third-party agreement you have entered into.

Third-Party Beneficiary

You and Saentisoft acknowledge and agree that Apple and Apple's subsidiaries are third-party beneficiaries of this EULA, and that, upon your acceptance of the terms and conditions of this EULA, Apple will have the right (and will be deemed to have accepted the right) to enforce this EULA against you as a third-party beneficiary of this EULA.

Safety and Responsible Use

Granum is a data analysis tool and does not replace proper firearms safety training, sound judgment, or compliance with applicable laws and regulations. Always follow all firearms safety rules and observe all applicable local laws and regulations when handling firearms. Saentisoft assumes no responsibility for how the information provided by the App is used.

Termination

This EULA is effective until terminated. Your rights under this EULA will terminate automatically without notice if you fail to comply with any of its terms. Upon termination, you must cease all use of the App and delete all copies from your devices. Saentisoft may also terminate this EULA at any time. Sections that by their nature should survive termination shall survive, including intellectual property, disclaimer of warranties, and limitation of liability.

Governing Law

This EULA is governed by the laws of Finland, without regard to conflict of law principles. Any disputes arising from this EULA shall be resolved in the courts of Finland.
